Right to Equality and Non-Discrimination against the Persons with Disabilities: A Case Study on Public Transport in Bangladesh

Abstract

The principle of equality and non-discrimination as a foundation of human rights requires us to treat everyone with dignity and respect in every area of life. This is especially crucial for persons with disabilities (PWD) who, due to obstacles and prejudices, have their full participation in society limited. In public transport, provision of accessibility and inclusivity is essential to se-cure the mobility rights of PWD. This study analyses the Bangladeshi situation with regards to the right of persons with disabilities to equality and non-discrimination in relation to transport. Based on preliminary data from interviews, surveys and observations with public transit users this study discusses several barriers to full participation and inclusion of PWD in public transportation. Moreover, it discusses the scenario and concerned laws, which are currently in force to protect the rights of PWD regarding public transport system introduced by the government. Second, by examining the effectiveness of such projects, the study identifies some current shortfalls and directions for effort to achieve equal access to transportation for all members of society. Analyzing the comparative study, this study ends with suggestions for policy and practice that could ensure equality and non-discrimination along with an inclusive transport regime for PWD.

    Shakila is an advocate currently practicing in the Comilla District & Sessions Judge Court. She was born on May 25, 1996, in Chandpur district, she holds an LL.M degree from Comilla University, completed in the 2019-2020 academic session with a GPA of 3.48 out of 4.00. She also earned her LL.B from Comilla University in 2019 with a CGPA of 3.51 and has strong academic credentials from her earlier studies, including top grades in her H.S.C and S.S.C exams.

    Shakila possesses extensive knowledge of government regulations, laws, legal codes, and international conventions, with particular interest in family law, civil procedure, taxation, corporate law, criminal law, property law, contract, tort, and legal research methodology. Beyond her advocacy work, she is deeply passionate about legal education, aiming to shape young minds through interactive teaching methods and positive reinforcement. She brings creativity, organized lesson planning, and flexibility to her teaching approach.

    She is a proactive, honest, and efficient legal professional with training in advocacy from the Judge Court in Comilla since March 2024. With her blend of legal practice and academic dedication, Shakila stands out as a competent and promising advocate with a strong foundation in both law and teaching.

    Md. Shamim Ahmed is a Lecturer in the Department of Law at Bangladesh Army International University of Science and Technology (BAIUST), Cumilla, and an Advocate at the Comilla Judge Court. He previously served as a Lecturer at CCN University of Science and Technology, where he earned recognition for his dynamic teaching approach and research-oriented instruction.

    Mr. Ahmed holds an LL.M. (Master of Laws) and LL.B. (Bachelor of Laws) from Comilla University, achieving First Class results in both programs. His academic and professional pursuits are deeply rooted in areas such as International Law, Human Rights Law, Jurisprudence, Comparative Family Law, Civil Procedure, and Legal Research Methodology.

    As a passionate educator, Mr. Ahmed emphasizes critical thinking, research engagement, and practical application of legal principles in his teaching. He actively encourages students to connect theoretical frameworks with real-world legal issues, fostering analytical and ethical reasoning skills essential for the modern legal profession.

    Mr. Ahmed has published several peer-reviewed journal articles, including “The Legal Status of Ethnic Minorities in Bangladesh: An Exploration of Human Rights” and “Rights of Child Labour in Brick-Kiln Industries of Cumilla District: A Study on the Basis of National and International Instruments.” His research contributions reflect a strong commitment to advancing human rights and promoting social justice through legal scholarship.

    He has been honored with awards such as the Human Rights Activist Award (2017), Most Promising Team Award (1st National IHL Moot Court Competition, 2019), and the Spirit of SCLS Award (2017). With a profound dedication to legal education and advocacy, Md. Shamim Ahmed continues to inspire future legal professionals while contributing meaningfully to Bangladesh’s legal academia and justice system.
